LSU Scholarly Repository Submission Agreement

By submitting materials to LSU Scholarly Repository, I grant Louisiana State University (the "University") a worldwide, royalty-free, perpetual non-exclusive right to copy, display, perform, distribute, preserve, and/or publish, in any format, the materials (the "Submission") I submit to the LSU Scholarly Repository institutional repository, for use in connection with the University's digital repositories, educational, and/or scholarly activities. Except for the non-exclusive rights set forth in this Agreement, no other rights in the Submission are being granted to the University.

I represent that:

  1. I am either the owner of the copyrights in the Submission or have the express written permission of the copyright owner(s), and, therefore, have full authority to grant the rights set forth in this Agreement;
  2. The Submission does not infringe on any copyright or other intellectual property rights of any third party, nor does the Submission contain any libelous matter or otherwise infringe any other rights of any third party.
  3. If the Submission contains any material, including images and graphs, for which I do not hold the copyright and that does not constitute fair use under the Copyright Act, 17 U.S.C. §§ 101, et seq., such material is clearly identified/acknowledged within the Submission, and I have obtained the written permission of the copyright owner of such material to grant the rights set forth in this Agreement; and
  4. There are no restrictions or required publication delays affecting the University’s distribution or other use of the Submission, so the University may immediately post my Submission to the LSU Scholarly Repository except as indicated in writing simultaneously with the deposit of the Submission.;

I agree to indemnify and hold the University, and/or its employees and agents thereof harmless for any liability, costs and fees arising from a breach of any of the foregoing warranties.

I understand that LSU Scholarly Repository was established to provide open access to a wide range of university-related digital content, and that content posted to the LSU Scholarly Repository may be freely accessible to the public. If my Submission is posted to the LSU Scholarly Repository, the Submission shall include my name and may also include other information, as applicable.

I further understand that the University has the right, in its discretion, to refuse to include any Submission in, or to withdraw any Submission from, the LSU Scholarly Repository. Once a Submission is deposited with the LSU Scholarly Repository a bibliographic citation to the Submission may remain visible in perpetuity, even if the Work is removed from the repository.
